Terms of Service

Welcome to Builtin. By accessing our website at builtin.co.in or purchasing any of our website packages, subscriptions, or maintenance plans, you agree to comply with and be bound by the following terms and conditions.

1. Service Offerings

Builtin provides two distinct business models for custom website design and development:

• Standard Custom Packages (One-Time Fee): Standard design models where clients make a one-time payment for design, development, and launch. Includes 1-year free hosting, domain name registration, SSL, and 1 month of support. Builtin retains full ownership of all website design assets, files, and source code. Clients are granted a license to run the completed website on Builtin's hosting infrastructure, and files or code are not provided.
• Subscription Packages (Pay-Monthly / WaaS): Website-as-a-Service model where clients pay a recurring monthly fee. We build, host, configure, and maintain the website. There is zero upfront cost, and the monthly subscription fee covers ongoing hosting, domain renewal, SSL, and active edits.

2. Subscriptions & Ownership

For our Subscription Packages (Static, Dynamic, E-Commerce monthly plans):

• Ownership: Builtin retains full ownership of the website design, source code, hosting servers, configuration, and the registered domain. The subscription operates on a service rental model.
• Cancellation: If you choose to cancel or pause your monthly subscription, the website will go offline at the end of the current billing cycle. You do not have the right to transfer the website files, design, or database to another server upon cancellation.
• No Transfer Policy: Subscription source code and custom graphics are proprietary and cannot be exported or migrated away from Builtin's hosting infrastructure.

3. Client Responsibility & Assets

To ensure on-time delivery (e.g. 7-day delivery for static sites), you are responsible for providing all necessary business content, text details, high-quality images, and product lists. Delays in providing this content will result in extensions to the delivery date. You certify that all content provided (images, logos, brand texts) belongs to you and does not infringe on copyright laws.

4. Support & Maintenance Limits

Standard plans include 1 month of free maintenance, while active subscriptions include maintenance for the duration of the subscription. Maintenance covers bug fixes, minor content changes, swapping images, and minor CSS layout adjustments. It does **not** include rebuilding pages, custom web application scripting, or adding complex new functional modules, which will be quoted separately.

5. Billing and Payments

All invoicing is carried out in Indian Rupees (INR). Payments for standard packages are structured on milestones (e.g., 50% advance, 50% post-launch approval). Subscription payments are billed in advance on a recurring monthly cycle. If a payment fails or is not processed within 7 days of the invoice date, Builtin reserves the right to temporarily pause and take your website offline until billing is settled.

6. Limitation of Liability

Builtin will not be held liable for any direct or indirect business losses, lost revenue, database loss, or operational downtime arising from website interruptions, hosting provider server outages, configuration issues, or gateway errors.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
